Court Overturns $500 Million Judgment Against Trump in NY Fraud Case, But He Remains Liable for Fraud

In a recent development, a New York appellate court has overturned a nearly half-billion-dollar judgment against President Donald Trump in a civil fraud case initiated by the state’s attorney general. Although not unanimous, the decision maintains Trump’s liability for fraud. The judges supporting his liability chose to discard the penalty to facilitate further appellate review.

The majority opinion stated, “Although the injunctive relief issued by the court is meticulously designed to correct defendants’ business practices, the court’s disgorgement order, which demands that defendants pay approximately half a billion dollars to the State of New York, constitutes an excessive fine that contravenes the Eighth Amendment of the United States Constitution.”
