Supreme Court Allows Trump Administration to Freeze $4 Billion in Foreign Aid Amidst Controversial Pocket Rescission

The Supreme Court’s conservative majority permitted the Trump administration to halt the disbursement of over $4 billion in foreign aid previously authorized by Congress on Friday. This decision followed an earlier order by a federal judge in Washington D.C., who mandated the release of these funds before the end of September, an instruction that was subsequently appealed by the administration.

In their ruling, the court’s conservatives asserted that the president’s foreign policy authority overshadowed the concerns raised by international aid organizations who initiated the legal challenge. They also implied that these organizations might not possess the necessary standing to instigate litigation.

Justice Elena Kagan expressed reservations regarding the hasty nature of the decision-making process, which was expedited through the court’s emergency docket. In her dissent, she stated, “We have been compelled to assess this application under time pressure — less than three weeks. Our consideration has been limited to sparse briefing, no oral arguments, and a lack of opportunity for deliberation.”

Last month, President Trump announced his intention to withhold $4.9 billion in foreign aid funds approved by Congress through a contentious and seldom-used authority known as a pocket rescission. Under normal circumstances, lawmakers are given 45 days to evaluate a request to rescind or cancel appropriated funds. However, when such requests approach the end of the fiscal year, the president may circumvent the legislative branch. Since the 1970s, this particular authority has not been invoked.

The pocket rescission targets funds allocated for development assistance grants, the United Nations, and international peacekeeping operations.
